Can you get spousal support before your divorce is final?

Divorce often brings changes to how you and your spouse manage household expenses. Covering bills that you once shared might now put extra pressure on your budget. With the divorce still underway, you may want to know whether your spouse can help with these costs until the case ends.

In Texas, you can request temporary spousal support before the divorce is final. A judge may order your spouse to contribute toward living expenses while the case continues. Whether the judge grants your request depends on your financial needs and your spouse’s ability to pay.

How temporary support works

Once either spouse files for divorce, you can ask for a temporary order that requires payments during the case. This lets the judge address your current needs without waiting for the final ruling.

After you and your spouse receive notice, the judge holds a hearing where you both have a chance to explain your income and expenses. If the judge approves your request, the order states how much your spouse will pay. The payments usually end with the final divorce decree, unless the court changes the order sooner.

Temporary support differs from spousal maintenance, which covers payments after divorce and follows stricter eligibility rules. Receiving payments now does not guarantee maintenance later.

Showing why you need support

Pay stubs and bank statements help the judge understand both what you earn and how much you currently have available. Your monthly bills provide another part of that account by showing what you spend on basic needs and whether your income covers those costs.

The judge also looks at whether your spouse can afford payments after covering their own reasonable expenses. Even if your spouse earns more than you, that alone does not guarantee support. The court may weigh both of your budgets.

Planning for the months ahead

Since a hearing may take time, you might want to organize recent bills and income records before making your request. Learning more about financial support during and after divorce could give you more context for what you are asking the judge to decide. As your expenses change during the case, a current budget helps show what you actually spend.
